Terms and Conditions of Sale 1. General 1.1 These Terms and Conditions apply to all transactions between the partnership of Push Posters, PO Box 327, Clydebank, G81 3HE (“Push Posters”) and any party purchasing Goods (the “Customer”) from www.pushposters.com and www.pushposters.co.uk (the “Site”). 1.2 These Terms and Conditions take precedence over and exclude any terms and conditions which the Customer may introduce. 1.3 Throughout these Terms and Conditions, when we refer to ‘we’, ‘us’, ‘our’ etc., we are referring to Push Posters. When we refer to ‘you’ etc. we are referring to you, the Customer. 2. Goods Push Posters has taken all reasonable steps to ensure that the Goods are described as fairly and accurately as possible. We also endeavor to ensure that all price and availability information is published as accurately as possible and is kept up to date. In the unlikely event that the Site contains any inaccurate, incomplete or out of date information we shall endeavour to rectify this as soon as practicable. 3. Steps to go through to place your Order 3.1. This Clause sets out the steps which you are required to go through to place your Order. We advise you to read these steps carefully. A contract of sale will come into force when we send you an e-mail confirming receipt and acceptance of your Order. Good Selection 3.2. If you wish to make a purchase from the Site, you should click on the “Add to Cart” icon next to the Good. You will then be asked to insert the shipping area to which we shall dispatch your Goods. This is required so we can calculate the relevant delivery charge applicable to your Order. 3.3. You will then be directed to a screen which shows the details of the Goods you have selected. You may amend your Order and remove a particular Goods by clicking on “Update Changes”. If you are satisfied that your Order details are correct, click on the “Proceed to Checkout” link. You will then be asked to insert the shipping details to which the Goods will be dispatched. You will be given the opportunity to amend these details if they are incorrect before proceeding. 3.4. Following the insertion of the shipping details, a screen will display the total cost of the Goods including postage. [You will at this stage be presented with these Terms and Conditions of Sale. You will then be taken to the payment section of the Site. You may pay for your Order using various methods including credit card, debit card, cheque, postal order, cash, money order or PayPal depending on your preference and where you are based, please see Accepted methods of payment for more details. 3.6. You should follow the on-screen instructions dependant on your method of payment. When you click on “Submit”, your order will be sent to Push Posters. A message will appear on screen acknowledging this and showing your Order details and allocating you an Order number. We suggest that you print this screen out and keep it for your records. Included in this confirmation e-mail will be notice regarding your right to cancel your Order for any reason up to 7 days (beginning the day after you receive the Goods). You should read this confirmation e-mail carefully. 3.8. When you place an Order with Push Posters, this constitutes an offer from you to purchase a Good from us. Up until the point where we accept this offer, either party may freely withdraw from the transaction with no liability to the other party. 3.9. Acceptance of your Order and conclusion of the Contract will take place when we send you an e-mail confirming that we accept your offer. We must receive payment of the whole price for the Goods before your Order will be accepted. 4. Price 4.1. All sums quoted by Push Posters are inclusive of Value Added Tax (VAT), where applicable. 4.2. The Price to be paid by the Customer is the price displayed on the Site at the time Push Posters receives the Order. We will try to ensure that all prices on the Site are accurate. If any pricing errors come to our attention, by whatever means, we will take reasonable steps to inform you and we will give you the option to reconfirm the Order at the corrected price or cancel it. If we cannot contact you, the Order will be treated as cancelled. If the Order is cancelled, for whatever reason, a full refund will be made. 5. Payment 5.1. Payment can be made by any method specified in the Payment section of the Site. We take all reasonable precautions to keep your order and payment details secure. 5.2. You confirm that the credit or debit card with which you make payment is held validly in your name. We cannot be held liable for any delays or non-delivery which may occur if credit or debit card provider does not authorise payment. You should also ensure that any information supplied by you is correct before proceeding to payment. Push Posters does not accept responsibility or offer refunds if you provide incorrect information. 6. Delivery and Returns 6.1. Delivery charges are detailed in the Shipping Rates section of the Site with delivery times detailed in the Expected Delivery Times section. Push Posters will make all reasonable efforts to deliver the Goods as soon as possible after your Order is accepted. All delivery times quoted on the Site are estimates only and are based on availability. 6.2. The risk in the Goods shall pass to you on delivery or attempted delivery of the Goods, which means that you are responsible for the safe-keeping of the Goods from that point on. 6.3. We suggest that in order to ensure we deal with your returns quickly, you notify us of any shortage, damage or defect in the Goods within 10 days of delivery. If the Good is found to be faulty or defective, then we will offer you either a replacement or a full refund where appropriate. You may also return the Good for any reason within 7 days of delivery and we shall provide you with a refund minus any delivery costs incurred in the return of the Goods. 7. Quality and Limitation of Claims 7.1. Push Posters shall use its reasonable endeavours to ensure the Goods are of satisfactory quality, comply with the descriptions given and are fit for the purpose for which the Goods are reasonably intended. 7.2. Nothing in these conditions excludes or limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation. 7.3. Subject to conditions 7.1 and 7.2 our total liability to you of any kind will be limited to the price of your Order. 7.4 The Goods made available on this Site are neither provided by nor endorsed by any band or singer. 8. These Terms and Conditions do not affect your rights under law.
